Trademark FAQs - related questions & answers
Question: What is the difference between the notations TM or SM and the ®?
Answer: Any time you claim rights in a mark, you may use the "TM" (trademark) or "SM" (service mark) designation to alert the public to your claim, regardless of whether you have filed an application with the USPTO. You may use the federal registration symbol "®" only after the USPTO actually registers a mark.
Question: Are there federal regulations governing the use of the designations "TM" or "SM" with trademarks?
Answer:
No. Use of the symbols "TM" or "SM" (for trademark and service mark, respectively) may, however, be governed by local, state, or foreign laws and the laws of the pertinent jurisdiction must be consulted.
Question: What is a License?
Answer:
A license is a contractual agreement between the licensor (government or technology developer) and the licensee. The licensor grants to the licensee the right to use or develop the technology for a fee.
